Brief Description
Amendment No. 36 of the 1982 Criminal Procedure Ordinance 2002 added Sections 59A and 62A. According to these sections, a police officer and/or a public prosecutor may not rely solely on a spouse's request as an indicator for the determination whether the matter is one that lacks public interest, thus justifying not conducting an investigation or prosecution in a sexual or violent offence among spouses. This stems from the known fact that in many of these cases the victim wishes to rebut her claim, although it has great substance, due to fear from the assailant.
